Government, tour operators, service providers... What is their duty of care if an act of terrorism takes place when you're travelling?

 

Airlines, hotels, and other service providers have gone out of their way to help travellers in the aftermath of acts of terrorism in recent years, but the increasing incidence of terrorism is making this difficult financially and can’t always be expected. What are your rights if you’re indirectly affected by terrorism while travelling?

The first responsibility lies with the UK Foreign and Commonwealth Office (FCO) in providing global travel advice, and with travellers in heeding that advice. If the FCO advises against travel to a destination (or against all but essential travel) before you book flights or accommodation, most travel insurance will be invalid and you’re unlikely to recover any costs, so always check first! The FCO also can’t guarantee assistance if you ignore their travel advice.

 

Government’s Duty

Exceptional Assistance Measures (EAM) are implemented in extreme circumstances to assist British victims of terrorism overseas and their families.

It’s important to note that, according to the FCO website, “EAM only covers incidents overseas that are deemed to be acts of terrorism by Her Majesty’s Government. They do not replace travel insurance. British nationals travelling overseas are strongly advised to take out comprehensive travel insurance. Those that do not and are involved in accidents or incidents often deeply regret it when faced with huge bills.”

The FCO also advises that EAM “…will only be activated as a last resort, where financial assistance is not made available by other means.”

 

Tour Operators and Service Providers

Package tour providers (tour operators) would be obliged to provide equivalent alternative arrangements or refunds, however any other cover would depend on individual travel insurance policies.

Travel and accommodation booked independently will depend on each provider’s policies and decisions.

Annual Multi-Trip Cover
